Terms of Use

These terms are an agreement between you and Longyan Xinluo Zhejia Technology Co., Ltd. (“we”, “us”), which operates Gen2. By using Gen2 you agree to them and to our Privacy Policy. If you downloaded Gen2 from the App Store, Apple’s Licensed Application End User License Agreement also applies; if the two conflict, these terms apply to the extent allowed.

1. Who can use Gen2

You must be at least 13 years old, or older if the law where you live requires it. If you’re under the age of majority where you live, you need permission from a parent or guardian.

2. Your account

You sign in with Apple or Google. Keep access to that account secure; you’re responsible for what happens under your Gen2 account. You can delete your account at any time in the app.

3. Credits and purchases

• Creating artwork uses credits. The number of credits each style uses is shown before you start.
• If a generation fails or is stopped by our content checks, the credits it used are refunded automatically.
• Credits have no cash value, can’t be transferred or exchanged, and are tied to your Gen2 account.
• Purchases are made through the App Store and are subject to Apple’s terms. Refund requests are handled by Apple. If a purchase is refunded, the credits it added are removed from your balance.
• Gen2 Plus is an auto-renewing subscription. It renews at the end of each period unless you turn off auto-renew at least 24 hours before the period ends. You can manage or cancel it in your iPhone’s Settings under your Apple Account. Credits included with a subscription are added each time it renews.
• We may change prices or the credits a style uses. Changes don’t affect credits you already have.

4. Your photos

You keep all rights to the photos you upload. You give us permission to store, process and send them to our service providers only as needed to run Gen2 for you, as described in our Privacy Policy. This permission ends when you delete the photo or your account.

Only upload photos you have the right to use. If a photo shows other people, make sure they’re fine with it being edited and shared.

5. The images you create

• As between you and us, you own the artwork and posters you create with Gen2, and you may use them for personal or commercial purposes, as long as that use is lawful and follows these terms.
• Artwork is made by AI. It may look different from your photo, contain mistakes, or resemble images created by other people. Don’t use it where accuracy matters, such as identity documents.
• Saved images carry metadata showing they were created with AI. Don’t remove it, or present AI-created images as real photos, in order to mislead people.

6. What you must not do

• Upload or create anything illegal, including sexual content involving minors, or sexual or intimate images of anyone without their consent.
• Use Gen2 to harass, threaten, impersonate or deceive people, or to violate their privacy or publicity rights.
• Infringe anyone’s copyright, trademark or other rights.
• Create content that promotes violence, hatred or self-harm.
• Interfere with Gen2, get around limits or security measures, reverse engineer the app, or access our services by automated means.

We may decline a request, remove content, or suspend or close an account that breaks these rules. To report content or a misuse of Gen2, email gen2@o-c.do.

7. Our app

Gen2 — its design, code, styles and layouts — belongs to us and our licensors. We give you a personal, non-exclusive, non-transferable license to use the app for as long as you follow these terms. We keep improving Gen2 and may add, change or remove features and styles.

8. Ending your use

You can stop using Gen2 and delete your account at any time. We may suspend or end your access if you seriously or repeatedly break these terms, or if we stop offering Gen2. If we stop offering Gen2, we’ll give you reasonable notice so you can save your images.

9. Disclaimers

Gen2 is provided “as is”. To the extent the law allows, we don’t promise that it will always be available or error-free, or that artwork will meet your expectations. Nothing in these terms limits rights you have under consumer laws that can’t be waived.

10. Limitation of liability

To the extent the law allows, we aren’t liable for indirect or consequential losses, and our total liability for any claim relating to Gen2 is limited to the amount you paid us in the 12 months before the claim. This doesn’t limit liability that can’t be limited by law.

11. Changes to these terms

We may update these terms. We’ll change the date above, and for significant changes we’ll let you know in the app before they take effect. If you keep using Gen2 after that, the new terms apply.

12. Governing law

These terms are governed by the laws of the People’s Republic of China. If you live elsewhere, you also keep the protection of the mandatory laws of your country of residence, and you may bring claims in your local courts where that law allows.
